ANATEL, the Brazilian National Telecommunications Agency, informed the committee of Designated Certification Bodies (OCDs) that it will no longer permit the renewal of certificates that have been expired for more than 180 days (6 months).
This decision reinforces the rules set by Resolution No. 715, published in 2019, which outlines the conditions for the suspension and cancellation of the Certificate of Conformity for telecommunications products.
The key points of the legislation, as stated in Section VII, include:
Article 52: The Certificate of Conformity can be suspended under several conditions, such as failure to make necessary product adaptations, non-compliance with follow-up contracts, misleading promotional dissemination of certification, or failure to maintain periodic certification for more than 180 days.
Article 53: If the suspension lasts beyond 180 days, and the issues causing the suspension are not resolved or justified, the Certificate of Conformity will be canceled.
- With this enforcement, companies holding expired certificates will no longer be able to renew them if more than 180 days have passed since expiration.
- For certificates that have been expired for more than 180 days, a new project application will now be required, which includes conducting new testing and obtaining a new ANATEL ID number.
- Manufacturers and importers are urged to ensure that their products’ certifications are renewed promptly within the allowed timeframe to avoid cancellations and disruptions in market access.
