From December 25, 2024, to February 25, 2025, the Ministry of Information and Communications (MIC) will conduct a public consultation on a draft Circular to replace Circular 30/2011/TT-BTTTT. This Circular regulates conformity certification and conformity declaration for specialized ICT products and includes amendments from Circular 15/2018/TT-BTTTT and Circular 10/2020/TT-BTTTT.
Key Points:
Conformity Assessment Methods:
- Products must apply the conformity assessment method specified in the relevant QCVN technical regulation.
- If QCVN does not specify conformity assessment methods, the method outlined in Appendix 1 of Circular No. 28/2012/TT-BTTTT (issued by the Ministry of Science and Technology) will be applied.
Validity of Certificates of Conformity:
- Certificates will remain valid for a maximum of 3 years or for each batch of products, depending on the conformity assessment method.
Declaration of Conformity (DoC):
- Domestically produced goods: DoC will be carried out at local Departments of Information and Communications.
- Imported goods: DoC will continue at the Department of Telecommunications, as part of the quality inspection process for imported goods.
Highlight of the Draft Circular:
- Aligns conformity regulations with general practices of the Ministry of Science and Technology, fostering consistency across ministries.
- Enhances the role of local management agencies, emphasizing their importance.
- For imported goods, the regulations are expected to have minimal immediate impact but bring long-term clarity and alignment with standard practices for imported products in Vietnam.
Promised Changes:
- The Circular represents a significant regulatory shift, marking a milestone after 13 years of Circular 30/2011/TT-BTTTT implementation.
Regulatory Impacts:
- Type Approval and Market Access Requirements: Yes
- Imports, Customs, Trade, or Market Surveillance: No
- Spectrum Management: Yes
- Technical Standards: No
This draft Circular signals a positive step toward regulatory modernization in Vietnam’s ICT sector. While final changes may still occur, the framework promises improved clarity and alignment with global practices.
