Kenya’s CAK Reinforces Requirement for Physical Sample Submission in Type Approval

The Communications Authority of Kenya (CAK) has reinforced the requirement for physical sample submission as part of its type approval process for telecommunications and radio equipment.

Recent developments indicate that applications submitted without a sample are no longer being accepted. While this requirement has always been included in the official CAK application process, it is now being applied more strictly in practice.

A physical sample must accompany all equipment submitted for CAK type approval. Applications that do not include a sample may not proceed through the approval process.

Clarifications from CAK

The reinforcement of this requirement provides important clarification for applicants:

  • Applicability:
The sample submission requirement applies to all categories of equipment, as outlined in the official CAK application form.

  • Large or Bulky Equipment:
There is no general exemption for large devices such as network switches, televisions, or similar equipment. Any exceptions are considered on a case-by-case basis by the relevant authority, depending on the product’s features and specifications.

  • Regulatory Status:
This is not a new regulatory requirement. The obligation to submit a physical sample has always formed part of the CAK type approval process. Previous instances where approvals may have been granted without a sample should not be interpreted as a precedent or exemption.

Manufacturers and importers seeking type approval in Kenya should ensure that a compliant physical sample is prepared and submitted as part of their application. Failure to meet this requirement may result in delays or rejection of the application.

This update serves as a reminder that adherence to all documented submission requirements is critical, even where past practices may have appeared more flexible.
