Additional Guidelines for issuing Experimental and Demonstration Licenses

With further reference to the existing WPC Office Memo No. R-14016/0112019-NT(Pt.) dated 23rd July 2019 few changes have been introduced with regard to the fixed timelines and other terms and conditions for Experimental and Demonstration license for radiating category

The important addition is the requirement of ‘inter-ministerial consultation’ as applicable.

Experimental License (Radiating mode)

For cases where inter-ministerial consultation is not required.

Once the application is submitted and the decision is not conveyed to the applicant even after 30 days license under this category will be deemed granted.

Any discrepancy noticed in the application the applicant will be informed within 7 days from the date of receipt of submission.

For cases where inter-ministerial consultation is required

WPC will send the communication seeking inter-ministerial consultation if applicable within 7 days from the date of receipt of application

Provisional license will be granted within 60 days from the date of seeking inter-ministerial consultation if the comments are not received

Provisional license will be converted to regular license on completion of 90 days provided there are no adverse comments.

Other terms and conditions.

Provisional license will be cancelled in case the comments received from the ministry is unfavourable and the experimental activity will be stopped.

Applicants must submit an undertaking agreeing to the above condition at the time of initial submission.

In case of any cancellation of Provisional/Regular license or expiry of the experimental period, samples have to be shipped back to the country of Origin/destroyed as per WPC guidelines. Separate license as applicable has to be obtained if the samples are required to be retained.

Demonstration License ( radiating mode)

For cases where inter-ministerial consultation is not required.

Once the application is submitted and the decision is not conveyed to the applicant even after 15 days license under this category will be deemed granted.

Any discrepancy noticed in the application; the applicant will be informed within 7 days from the date of receipt of submission.

For cases where inter-ministerial consultation is required

WPC will send the communication seeking inter-ministerial consultation if applicable within 7 days from the date of receipt of application

License shall be deemed granted on completion of 45 days after seeking inter-ministerial comments.

Other terms and conditions.

In case of any cancellation of Demonstration license or expiry of the demonstration period, samples have to be shipped back to the country of Origin/destroyed as per WPC guidelines. Separate license has to be obtained if the samples are required to be retained.
